Copyright infringer Ed Sheeren faces a 20m dollars lawsuit by writers Martin Harrington and Thomas Leonards.
Thomas Leonards claim that photograph which sold 3.5m copies is largely a note for note copying of amazing, is disturbing because of the strong likelihood of the claim.
The song, written in 2009, and recorded by x factor winner, Matt candle in 2012, sold 3.5m copies and was a huge success. The lawsuit focuses on choruses of two tracks whose copyright has allegedly been infringed by Ed Sheeran.
It rightfully alleges that the chorus section of amazing and photograph share 39 identical notes. The songs similarities reach the very essence of the work, according to the suit. I use the word rightfully, because it is pretty obvious, and we need not wait for the outcome of the case to make a stand here.’
SIMILARITIES
The similarities go beyond substantial, which itself is sufficient to establish copyright infringement, and are in fact striking, according to the compelling allegation.
The similarities of the words, vocal style, vocal melody, melody, and rhythm, are clear indicators among other things that photograph copies Amazing, meaning the notes are identical in pitch, rhythmic duration, and placement in measure.
These shocking allegations by writers who have written for Kylie Minogue and spice girl, Emma Button, look very bad for the accused, Ed Sheeren.
The lawsuit, filed by Richard Bunch, who once served as a lawyer for Martin Gayes family in the high profile case, blurred lines, settled for 5.3m dollars, will be one of the big lawsuits to occur in the music industry.
The plaintiffs are also seeking an injunction against Ed Sheeran for royalties and stator damages.
The eye of media.com as a team have listened to both songs and predict that the suit will be successful unless the defendants settle out of court.
Sheeran, along with Johnny Mcdad, Sony/At songs, Warner music and polar petrol music, are all named as defendants in the law suit.
