Former entertainer, Michael Barrymore, is suing Essex Police over his arrest in relation to the murder of Stuart Lubbock.
Barrymore was arrested after Lubbock was found dead in a pool at a birthday party of Barrymore at the star’ s Roydon home in 2007.
His lawyer argued in court that there was no foundation for the arrest , and that when ” rumour , speculation and conjecture” are out to one side, it is clear that Barrymore’s arrest had no evidential basis.
In addition, the “world wide publicity the arrest received affected his life and career ” , his lawyer argued.
Essex police have admitted that the rest was unlawful, but say another officer could have conducted the arrest lawfully.
According to police, there were reasonable grounds to suspect Barrymore of rape and murder, thereby justifying he arrest.
Barrymore has always maintained that he did not witness what happened to Lubbock, and would do anything to a support the investigation.
His counsel say his arrest 5 years after the crime lacked any ” evidential basis ” and his image was tarnished because of the arrest.
If successful, it will mean anybody wrongfully arrested for an offence that affects their life, will be liable to compensation.
