A Californian judge is facing wide outrage after slashing 15 years off the prison sentence of a paedophile convicted of raping a 3-year-old child.
Orange County Superior Court Judge M. Marc Kelly, has been lambasted for cutting the child rapist’s prison term down to ten years from 25 years after ridiculously claiming that “he didn’t mean to harm” the 3-year-old girl that he raped.He also backed the claim from child paedophile, Kevin Rojano, that the young girl initiated the act of sodomy. Rojano said in his own defense that “she asked me to do it.“
Evil Rojano was convicted on December 3 of sodomizing a child younger than 10 years of age, and committing lascivious acts with a minor. The pedophile was originally sentenced to 25 years to life in prison, but ridiculous Judge Kelly slashed a whole 15 years off Rojano’s sentence. His pathetic argument was that it would be “cruel and unusual punishment” to impose the maximum prison term because the 20-year-old lacked “callous disregard for (the victim’s) well-being.”
26-year-old Brooke Samson from California, told The Eye Of Media.Com”: This is completely outrageous. How can a judge reduce a sentence of a paedophile by so much. Foolish judgements like these make one wonder whether judges are taking bribes from associates of Paedophiles. How can a judge in his right mind make such a foolish judgment”?
Rojano was playing video games on June 4 in the garage of his Santa Ana home when his 3-year-old relative wandered in. Prosecutors said the man became sexually aroused by the child and assaulted her.
The girl’s mother tried in vain to get into the locked garage as she looked for the child, and prosecutors said Rojano covered the toddler’s mouth to keep her from yelling.
Rojano let the girl out of the garage, and her mother was unaware of the abuse until her daughter complained of pain. In his ridiculous statement, judge Kelly said;
“In looking at the facts of Mr. Rojano’s case, the manner in which this offense was committed is not typical of a predatory, violent brutal sodomy of a child case,” the judge claimed in his decision.
“Mr. Rojano did not seek out or stalk (the victim).
“He was playing video games and she wandered into the garage.
“He inexplicably became sexually aroused but did not appear to consciously intend to harm (the victim) when he sexually assaulted her.”
Judge Kelly shocked the court when he concluded that because Rojano was abused as a child, he deserved clemency since he said he regretted sodomizing the three-year-old girl.
“Although serious and despicable, this does not compare to a situation where a pedophilic child predator preys on an innocent child,” the judge said
“There was no violence or callous disregard for (the victim’s) well-being.” The judgment must be one of the most shocking in living memory concerning a paedophile. Suspicion of corruption has spread wide in a case in which stupidity prevailed over common sense. The inevitable implication of the judgment is that whenever a paedophile regrets sexually abusing a child, he should be afforded clemency once he expresses regret. The very strange verdict adds to a trend of judgments in which paedophiles appear to get away lightly for their vile offences. In 2017, appeal judges in London slashed 2 years of a 20 year sentence of deaf paedophile, Gamal Damian, after he claimed to be isolated in prison
Demain’s barrister Judith Benson had argued that : “His isolation because of his deafness within the prison is increased in comparison to an ordinary prisoner.
“He is unable to watch TV or partake in any other media of that sort. His life essentially consists of a period of time in workshops where he is able to have minimal communication.“Save for that, he has no means of communication or passing time, his barrister successfully argued
At the Court of Appeal, judge Adele Williams, said disability should not automatically result in a shorter term.
But she added: “We are persuaded some reduction is appropriate.”
In another horrifying judgment the same year, judges sparked outrage by slashing the prison sentence of a primary school deputy who hoarded films of the sadistic abuse of young children.
Stephen Horn, 34, admitted viewing child pornography over 13 years and downloading 20 hours of sickening footage.
He was jailed for 18 months in December and banned from having unsupervised contact with any child under 16.
Horn appealed the severity of his jail term which was reduced to ten months by three High Court judges including Lord Justice Adrian Fulford.
The Eye Of Media.Com strongly condemns his judgment and questions his moral and legal competence in arriving in this awful judgement. The judge’s decision to slash the sentence by so much gives the impression his judgement was motivated by other factors unknown to the public.
Shocked prosecutors have expressed strong disagreement with the judge’s “outrageous” decision to reduce Mr. Rojano’s prison sentence, and have vowed to appeal the sentence.
