A High Court in Belfast in Belfast has dismissed a legal challenge against a no-deal Brexit. One of the three cases dismissed was brought was by the victims’ campaigner Raymond McCord who plans to appeal the decision.
Arguments presented to the courts sere dismissed out of hand especially as they were lacking in any legal principle. Dismissing the case, the judge said the main aspects of the case were “inherently and unmistakeably political”. An argument presenting a no deal Brexit as detrimental to the Northern Ireland peace process was not based on any case law or legal reasoning.
Lord Justice Bernard Mclosky also ruled against considering a challenge from yesterday’s ruing that Parliament’s suspension is unlawful Minister criticised for ‘biased judges’ challenge against the suspension of Parliament because the issue formed the “centrepiece” of proceedings in England and Scotland.
A five week suspension of Parliament known as proroguing is currently active despite the ruling that the Uk prime minister’s advice to the Queen was unlawful and ”null and of no effect”. An earlier ruling from the High Court had stated that a decision to prorogue parliament was political and outside the scope of the courts, but that judgement has now been made redundant. Downing Street is appealing the decision of the courts in an appeal to be heard on Tuesday.
