Scotland’s Highest Court Says Suspending Parliament Is Unlawful

Scotland  highest civil court  has  ruled  that Boris Johnson’s suspension of the UK Parliament is unlawful.
A panel of three judges at the Court of Session found in favour of a cross-party group of politicians who were challenging the prime minister’s move. The  judges were unanimously concluded that Mr Johnson was motivated by the “improper purpose of stymieing Parliament”. In its ruling, it said:
“The Court will accordingly make an Order declaring that the prime minister’s advice to HM the Queen and the prorogation which followed thereon was unlawful and is thus null and of no effect.”The Court of Session decision overturns an earlier ruling from the court, which exonerated Johnson’s decision last week.

The British government said it would appeal the ruling to the Supreme Court in London. The ruling comes as a blow to the government which has long been desperate to get Brexit moving. Parliament had voted to mandate Boris Johnson to seek a 3 months extension from Parliament, something the prime minister said he would never do. Although it was suggested the prime minister to go to jail if he defied the court, another member of government could make the request for extension of the Supreme Court in London upholds the ruling in Scotland.
