Estate Agent Manager Accused Of Permitting Theft At Rented Property

An estate agent’s manager has been accused of  allegedly encouraging the theft of  goods belonging to a friend of an alcoholic man, after the man was hospitalised following a binge session of a few days.

Gary Hustwitt, 60, was a raging alcoholic who in past times waited for offlicenses to open at 8 am in order to buy his favourite beer, Capache.  Mr.Hustwitt, described as a legendary drinker, could go through over 8 pints of beer in day, though at the time of his hospitalisation had been drinking bottles of red wine, one after the other.

He got so drunk one  summer afternoon early in June, he had to be rushed to hospital, where he stayed for a whole week, before he was moved to a special care location under the supervision of social services, the eye of media.com learnt. Social services were made aware of his alcohol troubles late in 2019, but appeared to have no answers for the heavy boozer.

Mr.Hustwitt stayed in care until the first week in August when his tenancy expired, but  personal property belonging to  carer appears to have been deliberately withheld from him to spite the gentleman for criticising the estate agents for numerous failings, including the standard of the property.

Lawyers have analysed the odd situation in which Estate agent manager, Lauren Fynch(pictured) is believed to be using a potential loophole in the understanding of the law to encourage the permanent deprivation of the complainant’s goods from him- 5 weeks after he requested them.

A legal challenge is not believed to be worthwhile, but likely to be pursued if all inquiries eventually fails. First, the plan is to present a carefully presented case to police chiefs, making a worthwhile assessment into their own professional competence in their handling of the matter.

Reckless

Lauren Lynch- a manager at Appointmoore Estate Agents in Leigh On Sea, Essex,  has been accused of recklessly presiding over an arrangement that led to  the theft of a number of clothing items, books, and a pair of shoes of an individual who was caring for Gary Hustwitt in Westcliff Essex.

The stubborn manager is hiding under the technical argument that because the property alleged to have been stolen was at mr Hustwitt’s accommodation, it is a civil matter. Police contradicted themselves after first recording the incidence as a theft, before another officer overruled her colleague in a show of misjudgement in the law they ought to be enforcing.

Ms Fynch, two social workers, will be the subject of an investigation to be escalated to senior police officers in Essex Police. Two other police officers whose identity will not be disclosed at this point, are also accused of misconduct in aiding the questionable manager in acting dishonourably.

The decision of whether to name the officers was agreed to be held off until they and their superiors have been sent written complaints detailing the alleged misconduct, and affording them a response which would then be assessed. The same process is to be undertaken with the two social workers, who are also to be named and shamed after written complaints are sent.

Ms Fynch is believed to have abused her position in getting a  police officer to act in excess of his powers after senior officers said the matter was civil. Fynch, who was written to by Mr.Hustwitt early in 2020 to stop overseeing his property, after heeding complaints from neighbours without proper investigation, arrogantly ignored the mail and continued.

Vendetta

The Eye Of Media.Com can reveal that the withholding  or disposal of the property appears to have been conducted as a vendetta, after the estate agent under the leadership of Ms Lynch was criticised for incompetence and basic failings, not expected of an estate agent of appointmoor’s stature.

An assessment of Ms Lynch by our team shows her to be lacking in true leadership qualities. Essex Police confirmed they advised appointmoore to accompany the claimants of the goods to the property to identify his goods after which they can be photographed and identified for the tenant who was hospitalised following an alcoholic binge, to identify them.

Civil

However, the police told the estate agents it was a civil matter,  in the process giving appointmoor license to act as they pleased. But we can reveal that the rightful owner of the property has not received their goods for seven weeks now. We can also reveal that Ms Fynch initially threatened to evict Mr.Hustwitt, following a series of binge drinking that saw him urinate on himself while stuck on a sofa from which he made orders of wine.

There does not appear to be any intention to hand the property back.  Appointmoor are hiding under a woeful failing that questions their integrity in a case that saw an alcoholic hospitalised for at least a few weeks. He was moved from Southend hospital to an undisclosed location under the supervision of social services.

The  full story of the incidence is more comical than it is serious. The goods complained of all in total amounts to no more than £600. It includes a couple of  books provided to keep the man occupied while there, a number of shirts and trousers and some research material, and personal documents.

Annual Advance Payment

The whole incidence arose after the estate agent accepted an annual advance payment of £15k, despite mr.Hustwitt receiving no reference from his previous landlord.

The arrangement was negotiated by representatives of The Eye Of Media.Com under the guarantee that mr.Hustwitt, 60, would restrict his alcohol intake gradually from about 8 pints a day to 2 pints, and eventually to nothing. Under the arrangements, mr Hustwitt would have carers look after him. Mr Hustwitt signed an agreement to that effect, which the estate agent were made aware of.

However, Ms Fynch sought to rubbish the agreement, stating it was not legal, leaving Mr.Hustwitt to act as he pleased. Mr Hustwitt had been battling depression after his father John Stanley Hustwitt almost completely  froze him out of his inheritance, leaving him the bulk of his hard earned cash from stock broking to his sister.

Mr.Hustwitt had originally been receiving the odd £20 here and there, but after an intervention from this organisation, was in receipt of £100 weekly on top of hundreds of pounds handed over from his father in law from time to time to aid his alcoholic recovery.

Mr.Hustwitt’s brother in law, whose identity we will not reveal at the moment, also spent close to £1,000 on camera equipments, intended to aid mr. Hustwitt in collaborating with the eye of media.com in a planned youtube channel planned just before the lockdown in March. He acted on behalf of mr. Hustwitt’s sister.

His sister and her husband have not been directly notified about the missing goods, but Mr Hustwitt himself has, by mail and text. A family friend has also been told. Plans to put the pressure on Mr Hustwitt’s sister and her husband was deliberately delayed to allow enough time to see if  appointmoor takeany steps to address the problem.

Arrangements

Zac Weavers handled the initial arrangements and struck the deal, but Lauren Lynch, described as a ”bossy” woman, somehow found herself take over the overseeing of that particular property.  Mr Hustwitt himself expressed dislike of her, and wrote to her on one occasion telling her he did not want her handling his case any longer. However, bossy people do not go away so easily.

Mr. Hustwitt  reportedly made good progress for many weeks , but eventually  insisted on being in control of his alcohol intake. On one occasion he got so drunk that he urinated on himself while lying on his sofa, and panicking neighbours called the police at Ms Lynch’s advice when they smelt the odour coming from his flat. They thought it to be drugs.

Ms Lynch had initially threatened the eviction of mr Hustwitt, an outcome strongly requested by the neighbours at the Cul De Sac. But an eviction would have meant returning the shortfall of what had been spent from what was left.

Power Drunk

Ms Lynch believed to be a power drunk manager of the lettings team at appointmoore, was criticised by neighbours for allowing mr.Hustwitt to move into the property without a reference or a long term carer, but was also blasted for failing to repair a none functioning shower  in one of the two bathrooms at the property.  throughout the 10 months stay of the struggling alcoholic whose progress was up and down during his time at the residence.

The washing machine also did not work for months before it was repaired. The owner of the property has contacted both the estate agents and the tenant who lived at the property. Neither has responded.

The director of appointmoor, mr Bradley Daniels, has also been informed of the alleged theft by mail, but has not responded. Mr.Daniels own competence as a director is to be the subject of further analysis.Bradley Daniells, Managing Director

Mr Daniels has been notified of the situation on more than one occasion, but  has left it to the manager under him, whose judgment has been lacking in high proportions.

It may be that a bunch of unscrupulous individuals are operating as landlords of estate agents.

Ms Fynch and appointmoor were contacted for comment in relation to the aleged theft. Shamefully they had none to make.
