Gambling Commission To Run Consultation On Financial Penalties For Serious Breach

By Charlotte Webster-

The Gambling Commission has initiated a new set of consultations that will span 13 weeks. The primary focus of these consultations is on financial penalties, aiming to bring greater clarity and transparency to the calculation and enforcement of penalties in the gambling industry.

One key aspect of the consultation involves determining the starting point for the penal element of the penalty.

The proposed changes to financial key event reporting rules are designed to account for the increase in complexity of mergers and acquisitions, and the increased globalisation of gambling.

The consultation seeks views on new thresholds and reporting requirements for changes to finances, ownership and interests within gambling licensees.

The proposal suggests evaluating the severity of the breach and a percentage of the gross gambling yield or equivalent income generated during the period of the breach.

This approach seeks to establish a more standardized and transparent framework for imposing financial penalties, ensuring a fair and proportional response to regulatory violations.

The Gambling Commission is also turning its attention to financial key event reporting. Currently, licensees are required to provide the commission with pertinent information regarding ownership, finances, and interests.

The proposed amendments to these rules aim to account for the growing complexity of mergers and acquisitions within the industry, as well as the increasing globalization of gambling activities.

Kay Roberts, the commission’s Executive Director of Operations, emphasized the significance of these consultations in the broader context of maintaining effective regulation in the gambling sector. Roberts stated, “These consultations are part of our continued drive to ensure Britain has the world’s most effectively regulated gambling sector.”

The call for stakeholders, including industry representatives, experts, and the public, to participate in the consultations underscores the commission’s commitment to inclusivity and a collaborative approach to shaping regulatory measures.

Roberts urged stakeholders to actively engage in the process, stating, “We would urge all our stakeholders to take the time out to have their say on these consultations as all views on proposed changes will be considered.”

This move by the Gambling Commission comes at a crucial time when concerns about the social and economic impacts of gambling addiction have gained significant attention.
