The popular R&B singer Chris Brown, has been granted return to the US whils awaiting assault trial in London, stemming from an alleged bottle attack that occurred at a private members’ club in 2023. Judge Tony Baumgartner approved the significant change to the American musician’s existing bail conditions during a hearing held at Southwark Crown Court on Tuesday.

This ruling allows Brown to travel back to the United States ahead of his next scheduled court appearances, ensuring he can maintain his professional commitments despite the gravity of the charges he faces. The initial imposition of stringent bail terms had previously generated considerable media attention and debate over the standard treatment of high-profile international defendants.

Brown has officially pleaded not guilty to all three charges related to the incident. Specifically, he denies assault occasioning actual bodily harm to Abraham Diaw at the Tape venue, a private members’ club located in Hanover Square, Mayfair, on 19 February 2023.

The 36-year-old R&B star also strongly denied having an offensive weapon—specifically a bottle—in a public place. He denies the serious charge of attempting to cause grievous bodily harm. Prosecutor Heidi Stonecliffe KC confirmed that despite the modification allowing his departure, Brown’s overall bail conditions remained “very stringent” and “numerous.” Importantly, the substantial £5 million security fee Brown was previously ordered to pay to the court remains firmly in place as a guarantee of his future attendance.
The judge’s decision to permit the American musician and his co-defendant to return to the United States reflects a balance between ensuring judicial control and allowing them freedom to work. Brown’s co-defendant, US national Omololu Akinlolu, 39, also pleaded not guilty to assault occasioning actual bodily harm and was similarly granted permission to travel back home.

Judge Baumgartner addressed both defendants directly during the hearing, making clear the seriousness of their commitment. “You will have to come back to the United Kingdom when you are required to do so,” the judge stated, providing a firm reminder of their ongoing legal obligation.
He further cautioned them that failing to attend court dates when required would immediately jeopardise the substantial securities they have posted, underscoring the severe financial penalty involved. Brown’s previous bail conditions already permitted him to continue with his scheduled international tour commitments, but they imposed strict rules.

He had to live at a specific address known to the court, was explicitly banned from visiting the nightclub in question, was forbidden from making any contact with Mr. Diaw, and was restricted from applying for new international travel documents without court approval. The decision to permit their return suggests the court is satisfied with the existing financial guarantees, ensuring that Chris Brown granted return to US while awaiting assault trial will not impede the case’s progress.
The two defendants spoke only briefly during Tuesday’s hearing. They were asked primarily to confirm their identities for the record and to confirm they fully understood and accepted the updated conditions of their bail.
